The Fair Work Commission recently varied some Awards including, but not limited to the Clerks Private Sector Award 2010, General Retail Industry Award 2010, Plumbing and Fire Sprinklers Award 2010, Pastoral Award 2010 and Social, Community, Home Care and Disability Services Industry Award 2010 in relation to Annual Leave provisions including:
- Cashing out annual leave
- Taking annual leave in advance
- Managing excessive annual leave balances
In summary these changes result in an increase in flexibility for employees and employers in relation to managing annual leave. These changes took effect on the 29 July 2016 and the Fair Work Commission has updated the clauses in the various Awards that have been varied. The link below will take you to a summary table to indicate which awards have been impacted by the recent changes in annual leave provisions.
In light of this we recommend that you review your Annual Leave policies in ensuring they are updated to reflect any changes relevant to the Award covering your employees and/or business.
Award Free Employees
In relation to “Award free” employees and the increased flexibility outlined about, some aspects do differ and employers should determine the scope of changes to annual leave for Award free employees. Employees may cash out annual leave and an employer may still direct employees to take leave in instances where leave balances are deemed excessive.
Where organisations have a mix of Award and Award Free employees we recommend you apply the Award conditions as a base line to adopt a standardised approach across all employees.
