Employer obligations relating to sexual harassment are now more onerous and therefore it is essential and more important than ever, for an employer to addresses any matter relating to inappropriate workplace behaviours extremely seriously. An employer must be able to demonstrate they meet their obligations relating to sexual harrassment under the new laws which take effect 6th February 2023.

An employer cannot simply listen and investigate allegations of sexual harrassment. An employer must take action to proactively prevent sexual harrasment under new workplace laws. Approproate action includes:

  1. Train employees
  2. Robust policies and complaint resolution procedures
  3. Conduct exit interviews
  4. Take all allegations seriously
